1. Agreement to Terms
By accessing or using Kova Digital AI's services ("Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use our Services.
2. Description of Services
Kova Digital AI provides revenue infrastructure services including:
- 24/7 AI-powered voice receptionist systems
- Intelligent chat automation and lead qualification
- Calendar and CRM integration
- Automated appointment booking and follow-up
- Conversation logging and analytics
3. User Responsibilities
You agree to:
- Provide accurate business information for AI training
- Comply with all applicable laws and regulations
- Not use the Services for illegal or unauthorized purposes
- Maintain the security of your account credentials
- Notify us immediately of any unauthorized access
- Ensure compliance with call recording laws in your jurisdiction
4. Service Limitations
Our AI systems are designed to:
- Answer general questions about your business
- Qualify leads and collect information
- Book appointments based on availability
- Escalate complex situations to human staff
Our AI will NOT provide legal, medical, financial, or professional advice. It is not a replacement for licensed professionals.
5. Pricing and Payment
Pricing is custom based on your usage and integration needs. You agree to:
- Pay all fees according to your service agreement
- Provide valid payment information
- Pay invoices within 30 days of receipt
- Accept that prices may be adjusted with 30 days notice
6. Service Level Agreement
We strive for 99.9% uptime. In the event of service disruption:
- We will notify you of planned maintenance
- We will work to resolve unplanned outages within 4 hours
- Enterprise clients receive SLA credits for extended downtime
7. Termination
Either party may terminate the service agreement with 30 days written notice. Upon termination:
- You will be billed for services through the end of the notice period
- You may export your data within 90 days
- We will permanently delete your data after 90 days
- No refunds will be issued for partial months
8. Intellectual Property
Kova Digital AI retains all rights to our software, AI models, and infrastructure. You retain all rights to your business data, conversation logs, and lead information.
9. Limitation of Liability
To the maximum extent permitted by law, Kova Digital AI shall not be liable for any indirect, incidental, special, or consequential damages arising from use of our Services. Our total liability shall not exceed the amount you paid in the 12 months prior to the claim.
10. Indemnification
You agree to indemnify and hold harmless Kova Digital AI from any claims arising from your use of the Services, violation of these Terms, or violation of any rights of another party.
11. Modifications to Terms
We reserve the right to modify these Terms at any time. We will notify you of significant changes via email. Continued use of Services after changes constitutes acceptance.
12. Governing Law
These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles.
